PRIVACY NOTICE

Taller Jacobo y María Ángeles MR, (hereinafter the “Workshop”), with address at Callejón del Olvido number 9, San Martín Tilcajete, Ocotlán de Morelos, Oaxaca, issues this Privacy Notice so that the holder of the personal data (hereinafter the “Holder”), is aware of the treatment that the Company gives to personal data.

In the “Workshop,” we protect and safeguard the personal data of the Holder to prevent damage, loss, destruction, theft, misplacement, alteration, as well as unauthorized processing of the same, always in compliance with the provisions of Articles 8, 15, 16, 33, 36, and other related articles of the Federal Law on the Protection of Personal Data Held by Private Parties (the “Law”). For the purposes of this Privacy Notice, Personal Data shall be understood as any information concerning an identified or identifiable natural person. Likewise, all capitalized words that are not expressly defined in this Privacy Notice shall have the definition indicated in the Law.

PURPOSE OF THE PRIVACY NOTICE.

This Privacy Notice is made available to you with the intention that the Holder is aware of the processing that will be given to the same, as well as the precise information to exercise their rights of access, rectification, cancellation, and opposition (hereinafter “ARCO Rights”), which are described below:

1. Right to access your personal data held by the “WORKSHOP,” except in the cases mentioned in the Law.

2. Right to rectify your personal data when they are inaccurate or incomplete.

3. Right at all times to cancel your personal data. The “WORKSHOP” may deny the cancellation of the data under the terms established by the Law.

4. Right at all times and for legitimate reasons to oppose the processing.

It is important to inform you that the law protects the personal information of the Holder from unauthorized use and without their consent, so this document will inform you of the information we collect from the Holder, for what purposes and how we use it, the possible transfers to third parties, the purposes of data processing, their ARCO rights, as well as the revocation of their consent, which the Holder can assert before the “WORKSHOP” in order to have full control and decision over their personal data. For this reason, we recommend that you carefully read the following information:

This Privacy Notice applies to the Holders of Personal Data obtained directly, indirectly, or personally by the “WORKSHOP”, through processes of buying and selling products, contracts, letters, requests for information, verbal requests from employees of the “WORKSHOP”, as well as from the various forms contained on the website www.jacoboymariaangeles.com (hereinafter the “Website”) of the company or any other means specified for such purposes, that refer to this Privacy Notice.

FOR WHAT PURPOSES WILL WE USE YOUR PERSONAL DATA?

  • Personal Information is collected and stored for the purposes of identifying and verifying the User of the Website;
  • To establish contact with our clients to schedule appointments, send quotes for any product or service we offer, as well as various needs or clarifications that may arise from our consumers.
  • To enter into contracts with our clients arising from the products and services we offer as a “WORKSHOP.”
  • Operation, management, shipping of goods, returns, invoicing, collections, administration, provision of our services;
  • Delivery of notifications, requests, letters or newsletters, or attention to your requests related to the services we provide;
  • Help complete a transaction or order that has been initiated on the website; Analysis of user behavior and demographics;
  • Improve our business and promotional initiatives (marketing);
  • To create digital and physical marketing campaigns. Send information or messages about new products and/or services, as well as any other information; Display advertising or promotions of interest to our users;
  • Transfer of information from the Holder in applicable cases in accordance with the section "Transfer of Information to Third Parties" of this Notice;
  • Prevention or reporting to different authorities of illegal acts or facts;
  • Compliance with the Federal Law for the Prevention and Identification of Operations with Illicitly Obtained Resources and its Regulations. Comply with the exercise of ARCO rights as well as revoke the Holder's consent
  • Publish on social media and the website the work produced and services provided to our clients.

PERSONAL DATA

The Company will collect Personal Data from the Holder, which is voluntarily provided by the Holder or in response to explicit, express, or verbal requests from the Company; this data will be obtained directly from its holder and/or personally from its holder.

The Personal Data of the Holder must be truthful and complete. The Holder will be responsible at all times for the Personal Data provided, and under no circumstances will the "WORKSHOP" be responsible for the truthfulness of the same.

The Personal Data that may be requested from the Holder may be, in whole or in part, the following:

  • Name(s).
  • Last name(s).
  • Nationality.
  • Address(es).
  • Date of Birth.
  • Email.
  • Banking Information.
  • Tax Information.
  • Credit and/or Debit Card Information.
  • Home, office, fax, and/or mobile phone.
  • Social Media Accounts.
  • Company.
  • Date, amount, and payment method of contracts entered into with the "WORKSHOP."
  • Position within your company.

SENSITIVE PERSONAL DATA

The "WORKSHOP" informs its clients that it does not collect any type of sensitive personal data from its Holder, such as racial or ethnic origin, health status, present and future, genetic information, religious, philosophical or moral beliefs, union affiliation, political opinions or sexual preferences as referenced in Article 3, Section VI of the Federal Law on the Protection of Personal Data Held by Private Parties.

PROTECTION.

To ensure that personal data is processed in accordance with the provisions of the Law, the "WORKSHOP" complies with the following principles:

  1. To inform its clients of the purposes of processing their personal data, collecting only the necessary data to fulfill them, committing not to use them for purposes other than those established in this privacy notice.
  2. Perform the proper maintenance to ensure that your personal data is correct and up to date; if it is necessary to retain your data, it will be in accordance with the applicable law.
  3. Implement security measures to ensure the protection of your personal data.

DATABASE

The Database of the "WORKSHOP", where the collected information is stored, will keep the information provided by the Data Subject safe and protected, even if it is modified, updated, or even canceled for any reason. This is to maintain a history of the Data Subject and safeguard their legal interests. The retention of information mentioned in this paragraph may be deleted or removed in its entirety through the exercise of ARCO Rights.

CONFIDENTIALITY

The confidentiality obligations regarding the personal data of the Data Subject assumed by the "WORKSHOP" are excluded from application when the information in question falls under any of the following circumstances:

  1. It was known to the general public at the time of disclosure or became public or available without the intervention of the "WORKSHOP" or its personnel;
  2. It was in their possession before or at the time of disclosure without violating any legal obligation, provided that the source that revealed it was not bound by confidentiality obligations to the "WORKSHOP";
  3. It became information known or available to the “WORKSHOP” or its staff in a non-confidential manner through the disclosure of sources other than the Holder that were not bound by confidentiality obligations with the “WORKSHOP”;
  4. It is acquired or developed independently by the “WORKSHOP” without relying on the Holder's Personal Data, as a result of work performed by one of its staff members to whom such information has not been disclosed; or
  5. The “WORKSHOP” and/or its Affiliates are legally required to deliver, in which case it will immediately notify the Holder and take all reasonably available measures to ensure that the Personal Data disclosed is only what is necessary to comply with the requirement.

TRANSFER OF INFORMATION TO THIRD PARTIES

We inform our clients that the “WORKSHOP” does not transfer any of their personal data to third parties in reference to what is stipulated in Article 36 of the Federal Law on the Protection of Personal Data Held by Private Parties, therefore it commits to handle Personal Data as agreed in this Privacy Notice, with the understanding, however, that the “WORKSHOP” may disclose the Holder's Personal Data in the following cases:

  1. When it is mandatory to respond to requests from a competent authority, provided that it is duly substantiated and motivated or when any of the assumptions established in Article 37 of the relevant law is configured.
  2. To the various negotiations that are part of the “JACOBO and MARÍA ÁNGELES” MR business group, provided that they enter into a confidentiality agreement with the “WORKSHOP” in order to protect Personal Data and are obliged not to disclose Personal Data without the express and written authorization of the “WORKSHOP”; and
  3. To the officials and employees of the “WORKSHOP” and its subsidiaries of the “JACOBO AND MARÍA ÁNGELES” MR business group, as well as to external advisors for whom access to Personal Data is necessary or convenient.

For the purposes of this notice, “Subsidiary” of the “WORKSHOP” refers to the various negotiations that are part of the “JACOBO AND MARÍA ÁNGELES” MR business group.

ARCO RIGHTS (ACCESS, RECTIFICATION, CANCELLATION, AND OPPOSITION)

The Holder has the right, personally or through a legal representative, to request the Company, at any time, access, rectification, cancellation, or opposition regarding the personal data stored in the “WORKSHOP” Database.

The legal framework applicable to this request is found in Chapter IV of the Federal Law on the Protection of Personal Data (articles 28 to 35), Chapter VII Sections I to V of the Regulations of the Federal Law on the Protection of Personal Data (articles 92 to 111), and by the Guidelines of the Privacy Notice Twenty-fifth, Twenty-eighth, Twenty-ninth, and Thirtieth.

Our clients or their legal representative may exercise any of the rights of access, rectification, cancellation, or opposition known as “ARCO Rights,” as well as revoke their consent for the processing of their personal data, by sending an email to the following address privacidadgrupoJyMA@gmail.com where they will be attended to in a timely manner.

Your request must be made through electronic or physical means, in order to follow up on your application, and you or your legal representative must correctly verify your identity through valid official photo identifications such as (Voter ID issued by the National Electoral Institute, Passport issued by the Ministry of Foreign Affairs, Professional License issued by the Ministry of Public Education, Military Service Card issued by the Ministry of National Defense, Notarial Power, etc.)

In case the information provided is incorrect or insufficient, or if the corresponding accreditation documents are not included, you will be notified at the email address you provide within 5 business days following the receipt of the request, to require you to provide the necessary elements or documents to process it. You will have 10 business days to respond to the request, counted from the day after you receive it. If you do not respond within that period, the corresponding application will be considered not submitted.

The "WORKSHOP" will communicate the determination made to you within a maximum period of 20 business days from the date the request was received, so that, if it is deemed appropriate, you can make it effective within the following fifteen (15) business days after the response is communicated.

The response will be provided electronically to the email address specified in your initial request.

When the data is no longer necessary for the fulfillment of the purposes provided by this privacy notice and the applicable legal provisions, it must be canceled, blocked, and deleted by law.

PROCEDURES FOR BLOCKING AND DELETION OF PERSONAL DATA

Once the data has been canceled, the "WORKSHOP" will retain the personal data of the Holder for one more month for clarification purposes and preparation for deletion. Once this period has expired, the "WORKSHOP" will permanently delete the Holder's Personal Data, removing it from the database and disposing of all physical and electronic files related to the holder. If the Holder were to engage in another act with the "WORKSHOP", it must be initiated as if the relationship had never existed.

Personal data that has fulfilled its purposes but cannot be canceled and deleted by law or contractual obligation will be blocked from the purposes to which they were subjected until they can be deleted. During this period, the Personal Data may not be subject to processing.

CONSENT

The Holder states that they have read this Privacy Notice and consent to its stipulations. The Holder consents to this Privacy Notice in accordance with the Law.

REVOCATION OF CONSENT

Consent may be revoked at any time without retroactive effects. To revoke consent, the Holder must send a written request with the following requirements:

  • The name of the Holder.
  • Documents that prove the identity of the Holder, which must be official.
  • A clear and precise description of the relationship that the User has with the "WORKSHOP".
  • Provide documentation that supports the User's request.
  • That the letter is addressed to the "WORKSHOP".
  • To verify that the relationship with the 'WORKSHOP' has ended.

The 'WORKSHOP' will issue a response confirming the revocation of consent, or if applicable, will indicate the reasoning depending on the specific case, with the company having 15 calendar days to issue this response. The deadlines will be counted from the date the email has entered the 'WORKSHOP' server.

MODIFICATIONS TO THE PRIVACY NOTICE

The 'WORKSHOP', as well as the Holder, acknowledge that this Privacy Notice may be modified whenever required.

The 'WORKSHOP' reserves the right to make modifications to this Privacy Notice at any time to adapt it to any legal modifications, internal policies, new requirements for the provision or offering of our services or products, as well as market practices. It is the Holder's responsibility to periodically read the terms and conditions of this Privacy Notice to stay informed of such modifications, which will always be available to the Holder through the Website.

Modifications to this Privacy Notice will be communicated to the Holder through the portal of the 'WORKSHOP' Website.
